Article 1
|
In order to treat the vehicle which obstructs the traffic and eliminates the obstruction on highway, the Taoyuan County Government (hereinafter referred as this “County”) particularly promulgates these self-government ordinances. |
|
Article 2 |
The “Vehicle(s)” in these self-government ordinances shall include the
followings:
1. All kinds of motor vehicles with more than 2 tires;
2. Trailer, tractor-full trailer, tractor-semi trailer, trailer truck, full-trailer, semi-trailer, tractor and tractor frame;
3. Vehicles driven with human power or animal power; and
4. Other motor machinery which may drive on the highway. |

Article 3 |
Any vehicle shall be moved and detained, if the vehicle:
1. Is parked illegally and becomes obstruction to traffic;
2. Malfunctions during driving and the driver fails to move it properly, thus it becomes obstruction to traffic;
3. Is damaged to degree of not to be driven away due to accident and the driver fails to move it properly, thus it becomes obstruction to traffic; or
4. Is in other situation that the vehicle may be moved and detained according to laws or regulations. |

Article 4
|
The police bureau of this County (hereinafter referred as “Police
Bureau”) shall be the execution organization of affairs concerning the
movement and detention of the vehicles.
If it is in lack of trailer trucks, crane trucks or detention fields, the private trailer trucks, crane trucks or detention fields may be utilized.
The location of detention fields shall be announced. |

Article 5
|
While moving the vehicle, the police officer shall be along with the
trailer trucks or crane trucks in order to conduct affairs of accusation.
The car plate number of the vehicle and detention field’s location and
phone number shall be marked on the ground where the vehicle parks. |

Article 6
|
The vehicles moved to the detention field shall be handled according
to the following regulations:
1. The police officer along with the truck shall issue the vehicle movement notification to the staff of detention field for collection of movement fee and detention fee;
2. If the vehicle is parked illegally, the police officer shall issue the accusation notice for violation of highway traffic regulations to vehicle owner through the staff of detention field;
3. If the vehicle has been detained for more than 3 days and no one reclaims the vehicle, the staff of detention field shall report to the Police Bureau for identification of the owner, in order to inform the owner to reclaim that vehicle with a given time limit. If the owner fails to reclaim the vehicle with the given time limit or the owner of that vehicle is not registered, the notice to the owner shall be announced publicly for reclaim. If that vehicle is found stolen after investigation, the vehicle shall be returned to the owner according to the law and regulations; and
4. The detention field shall prepare registration books for recording the car type of the vehicle, location where the vehicle is moved from, detention period, fees to be paid and the name, address, ID number of the person who reclaims the vehicle; and the person who reclaims the vehicle shall sign or chop on the registration books for further reference.
If the announcement stated in the section 3 in the last paragraph concerning the vehicle not to be reclaimed in a given time or without registered owner has been made more than 3 months, and there is still no one to reclaim that vehicle, then that vehicle shall be sold by public bidding. The payment from bidding shall be deposited after deduction of fine due to violation of Statute for Road Traffic Management and Traffic Violation Punishment, movement fee, detention fee and other necessary expenses, |

Article 7
|
The movement fees of vehicles are regulated as followed:
1. Motorcycle: $NTD 100 for one vehicle each time;
2. Small motor vehicle: $NTD 600 for one vehicle each time;
3. Big motor vehicle: $NTD 2000 for one vehicle each time;
4. Tractor: $NTD 2000 for one vehicle each time;
5. Trailer, tractor-full trailer, tractor-semi trailer, trailer truck, full-trailer, semi-trailer and tractor frame: $NTD 5000 for one vehicle each time;
6. Vehicles driven with human power or animal power: $NTD 100 for one vehicle each time; and
7. Other motor machinery which may drive on the highway: $NTD 6000 for one vehicle each time.
The differential between the vehicles in section 2 and 3 in last paragraph shall follow the regulation in Article 3 of Statute for Road Traffic Safety. |

Article 8
|
The detention fees of vehicles are regulated as fallowed:
1. Motorcycle: $NTD 50 for one vehicle per day;
2. Small motor vehicle: $NTD 200 for one vehicle per day;
3. Big motor vehicle: $NTD 500 for one vehicle per day;
4. Tractor: $NTD 500 for one vehicle per day;
5. Trailer, tractor-full trailer, tractor-semi trailer, trailer truck, full-trailer, semi-trailer and tractor frame: $NTD 600 for one vehicle per day;
6. Vehicles driven with human power or animal power: $NTD 50 for one vehicle per day; and
7. Other motor machinery which may drive on the highway: $NTD 600 for one vehicle per day.
The detention fee in last paragraph shall be calculated by day, detention period less than 1 day shall be deemed as 1 day. |

Article 9
|
The regulation in these self-government ordinances shall be applied to
illegally parked containers. The regulations of the movement fee in
section 5, paragraph 1 of Article 7 and detention fee in section 5,
paragraph 1 of Article 8 shall be applied to the illegally parked container. |

Article 10
|
If there is any damage or loss of moved or detained vehicle due to
negligence of the person who moved or preserved the vehicle or the staff
of the detention field, that person or staff shall be responsible for such
damage or loss. |

Article 11
|
The preserver or the staff of detention field shall check the ownership
certificate of the reclaimed vehicles, receipts of movement fee and
detention fee as the vehicles are reclaimed. If any impostor or stolen
vehicle is found, they shall report what they have found to the Police
Bureau. |

Article 12
|
The plan concerning the procurement of trailer trucks or crane trucks,
establishment of detention fields or premises, employment of drivers,
mechanics and staffs shall be reported to this County for approval, and
then the budget shall be made for the approved plan. |

Article 13
|
The tables or forms for these self-government ordinances shall be
drafted by This County otherwise. |

Article 14
|
The Self-governance articles shall take effect upon the date of promulgation. |
